The H-1B visa has long served as a critical stepping stone for highly skilled professionals seeking permanent residence in the United States. For many, selection in the H-1B lottery represents a significant achievement and a chance to build a life and career in the U.S. Yet, the visa also brings with it considerable uncertainty.

While the H-1B visa allows individuals — particularly those completing Optional Practical Training (OPT) or STEM OPT extensions — to secure employment, the six-year cap and the challenges of employment-based green card sponsorship present major hurdles. Job loss or layoffs can quickly disrupt immigration status. Even for those who manage to remain in H-1B status beyond six years, the wait for a green card can stretch to 15–20 years, particularly for Indian nationals caught in severe visa backlogs.

For many H-1B professionals, years of work in the U.S. translate into substantial financial accomplishments: home equity, vested stock options, and strong savings. By investing $800,000 in a qualifying EB-5 project, typically through a U.S. government-approved regional center, investors can secure permanent residence in approximately two years. This is a dramatic contrast to the decades-long wait under employment-based categories. The regional center route is popular because it shifts the operational and compliance burdens — including the creation of 10 U.S. jobs — to professional developers, making it relatively streamlined and low-risk compared to direct EB-5 investments, where the investor must personally create and sustain those jobs.

The EB-5 program underwent significant reforms under legislation enacted in March 2022. The new rules introduced reserved visa categories, ensuring faster processing and priority placement for qualifying investors. These changes make EB-5 an even more attractive option for non-immigrant visa holders — not only those on H-1B status, but also L-1B and O-1 professionals seeking greater stability and independence in their U.S. immigration journey.

When selecting a regional center, prospective investors should carefully evaluate its track record: successful project completions, strong job-creation metrics, and consistent approvals of green card applications. Due diligence helps minimize risk while maximizing the likelihood of both financial and immigration success.
