The Trump administration, which aspires to get back the jobs from foreign workers for the sake of its American workforce, has taken another significant step towards its goal. With a new directive saying the burden of proof lies on the applicant during every extension, it has made it more difficult to renew non-immigrant visas such as H-1B and L1, which are popular among Indian IT professionals.
US Citizenship and Immigration Services (USCIS) has recently said the burden of proof in establishing eligibility is on the petitioner only, even when an extension of non-immigrant status is sought. The previous memorandum, which had been in effect since 2004, placed the burden on the federal agency.
According to the previous policy, if a person was once found to be eligible for a work visa, they would usually be considered for extension of their visa. However, as per the revised memorandum, they need to prove their eligibility to the federal authorities during every extension.
Experts say that the change would affect both new visa applicants and people already living in the country.
