Section 66 A calls for punishmentfor sending “offensive’ messages through computers or any other communication device such as a mobile phone or a tablet, and a conviction can fetch a maximum of three years in jail.
Politicians and various political parties at one time or the other using the cover of Section 66A arrested persons for posting what they called offensive comments on social media sites. Now Government and parties cannot do it anymore as Supreme Court even rejected Union Government’s plea. Many people across the country are celebrating Supreme Court ruling.
Everyone who are celebrating victory for free speech should thank woman behind the landmark Supreme Court ruling. Young law student Shreya Singhal, who was the first to challenge the draconian law said “I am ecstatic. It was grossly offensive to our rights, our freedom of speech and expression and today the Supreme Court has upheld that,”
Shreya approached Supreme Court at the age of 21 years by filing a petition in 2012, after Maharashtra government arrested two young women for posting comments criticizing total shutdown by Shiv Sena following death of Bal Thackery in Mumbai. Shreya said the section was misused by all political parties like BJP,Congress and others.
