US: Former Indian Students Targeted Over ‘OPT Fraud’ Notices

Amid shifting immigration policies and intensified enforcement actions, former international students on Optional Practical Training (OPT) or currently employed in the U.S. are facing a new and serious threat. Under the recently updated ‘Issue of Notice to Appear’ policy introduced by U.S. Citizenship and Immigration Services (USCIS), the Department of Homeland Security (DHS) is issuing notices based on undisclosed fraud findings. This action can trigger deportation proceedings, including potential arrest and detention. Many international students are being wrongly labeled as guilty of fraud by USCIS in alleged OPT scam cases.

The fraud stems from companies aggressively advertising consulting jobs to recent graduates and hiring students on OPT. These companies offer job placements but later claim additional training is needed, charge students for subpar training programs, fail to assign real projects, leaving students without legitimate work experience, and keep students in jobs that exist only on paper while they continue part-time work elsewhere. Despite DHS not issuing public warnings about these scams, it conducts raids on such companies, confiscates employee records, and cross-references them with government databases. This has led to unjust implications for students, even when they were unaware of fraudulent activities.

Immigration analysts advise affected students to seek legal help immediately. Those wrongfully implicated should approach USCIS through proper legal channels to have their names removed from fraudulent employer lists and avoid potential immigration consequences. Staying informed, consulting with experienced immigration attorneys, and ensuring compliance with OPT regulations are crucial for protecting one’s status in the U.S.
