High Court Slaps 10 Lakh Fine On RGV
Released in 2007, Ram Gopal Varma’s Aag is considered an epic disaster of all-time and the eccentric director is still targeted by the fans of the film’s original version, the yesteryear classic, Sholay. Even after 8 years, the sins committed by RGV by remaking the classic are still haunting him.
The Delhi High Court has slapped a fine of Rs. 10 lakhs on Ram Gopal Varma for ‘deliberately violating the exclusive copyright vested with the director Ramesh Sippy’, who helmed the 1975 blockbuster hit Sholay. The petition was filed by Sascha Sippy, son of GP Sippy, who produced Sholay. The high court imposed the fine on RGV and his production houses M/S RGV Productions Pvt Ltd, Varma Corporation Ltd and Madhu Varma and restrained them from using Gabbar Singh or Gabbar from Sholay.
“The use of similar plot and characters in the impugned film coupled with use of the underlying music, lyrics and background score and even dialogues from the original film Sholay amounts to infringement of copyright in the film Sholay,” the high court said in its judgment, charging Varma and his associate companies as guilty of infringement under Section 14(a) read with Section 55 of Copyright Act, 1957.
The high court further said that Ram Gopal Varma ke Aag ‘distorted and mutilated’ the original copyright work of the maker of original Sholay.
